In my case, I was simply told there had to be a “thermal barrier” between the brewery (also just a little 3bbl with taproom) and the apartments upstairs.  There was already a drop ceiling between the brewery and the original ceiling (or bottom of the apartment’s floors, depending on perspective), so we were good to go.

I will offer that you might want to try inserting the term “code variance” into the conversation, and see if it gains you any traction.  In my town, you can pay $150 to ask for a code variance review, and basically, if the city building official can’t figure out a way they’ll get sued for allowing you to vary from the building code, they approve it, and count their $150.  I had to get a handful.

You may want to see if you can get the production area considered a commercial kitchen?
